DEFINITIONS
1.1 "The Company" means Belfast Insulation Co Ltd.
1.2 "The Customer" means the person, company, organisation or property owner accepting the
Company's quotation.
1.3 "Works" means the installation, extraction or associated insulation services carried out by the Company.
QUOTATIONS
2.1 All quotations are valid for 30 days from the date issued unless otherwise stated.
2.2 Quotations are based upon information available at the time of survey and may be amended if unforeseen circumstances are discovered before or during the Works.
2.3 Acceptance of a quotation constitutes acceptance of these Terms and Conditions.
CUSTOMER RESPONSIBILITIES
3.1 The Customer shall provide safe and reasonable access to the property and work areas.
3.2 The Customer shall disclose any known defects, water ingress, structural issues, asbestos- containing materials, vermin infestations or other conditions that may affect the Works.
3.3 The Customer shall ensure that lofts, cavity walls and work areas are cleared of personal belongings where reasonably required.
3.4 The Company reserves the right to postpone or suspend Works where access is unsafe or unsuitable.
SURVEYS AND ELIGIBILITY
4.1 All recommendations are based on visual inspections and information available at the time of survey.
4.2 The Company cannot be held responsible for concealed defects that are not reasonably identifiable during the survey process.
4.3 If conditions are discovered that render the property unsuitable for the proposed insulation system, the Company reserves the right to cancel the works. If amendments can be made the Works to be carried out correctly and the customer agrees then works may continue.INSTALLATION WORKS
5.1 The Company shall carry out the Works using appropriately trained personnel and in accordance with relevant industry standards.
5.2 Installation methods may vary depending upon site conditions.
5.3 The Company shall take reasonable care to avoid damage to property but cannot accept liability for defects arising from pre-existing conditions.
CAVITY WALL INSULATION AND CAVITY CLEANING
6.1 Cavity wall insulation and cavity cleaning services are subject to the property being suitable following survey and inspection.
6.2 The Company cannot guarantee the condition of hidden wall ties, cavity obstructions or other concealed elements that cannot reasonably be inspected before work commences.
6.3 Any unforeseen defects identified during the Works shall be reported to the Customer as soon as practicable.
PAYMENT TERMS
7.1 Payment shall become due immediately upon completion of the Works unless otherwise agreed inwriting.
7.2 Commercial customers shall pay in accordance with agreed credit terms.
7.3 If credit terms are broken, The Company reserves the right to charge statutory interest and recovery costs on overdue accounts in accordance with applicable legislation.
7.4 The Company reserves the right to suspend further works where outstanding amounts remain unpaid.
7.5 All materials installed remain the property of The Company until paid for in full.
GUARANTEES
8.1 Any guarantee provided shall be subject to the terms and conditions of the relevant guarantee provider.
8.2 Guarantees shall be void where alterations, damage, misuse, neglect or unauthorised modifications affect the installed system.
8.3 The Customer shall retain guarantee documentation for future reference.
CANCELLATIONS
9.1 Customers may cancel an order by providing verbal notice a minimum of 24hrs before works commence.
9.2 The Company reserves the right to recover reasonable costs incurred prior to cancellation,
including surveys, materials ordered or specialist services undertaken.
LIMITATION OF LIABILITY
10.1 The Company's liability shall be limited to the value of the contract except where liability cannot be excluded by law.
10.2 The Company shall not be liable for indirect or consequential losses, loss of profit, business interruption or losses arising from matters outside its reasonable control.
10.3 Nothing in these Terms shall exclude liability for death or personal injury caused by negligence or any liability that cannot legally be excluded.
COMPLAINTS PROCEDURE
11.1 Any complaint regarding the Works should be submitted to the Company in writing within a reasonable period following completion.
11.2 The Company shall investigate complaints and respond within a reasonable timeframe.
11.3 The Customer shall provide reasonable access to enable inspection of any alleged defect.
HEALTH AND SAFETY
12.1 The Customer shall ensure that all occupants, pets and visitors remain clear of work areas during installation.
12.2 The Company reserves the right to cease work where health and safety risks arise.
DATA PROTECTION
13.1 Customer information shall be processed in accordance with applicable data protection legislation.
13.2 Information may be shared with certification bodies, guarantee providers, funding bodies or regulatory authorities where required for compliance purposes.
FORCE MAJEURE
14.1 The Company shall not be liable for delays or failure to perform its obligations due to events beyond its reasonable control including adverse weather, material shortages, labour disputes, utility failures or acts of government.
GOVERNING LAW
15.1 These Terms and Conditions shall be governed by the laws of Northern Ireland.
15.2 Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Northern Ireland.
